Supreme Court: Oral arguments for Bruesewitz v. Wyeth

Tuesday, October 12 the Supreme Court heard oral arguments on Bruesewitz v. Wyeth.

“The National Childhood Vaccine Injury Act protects vaccine manufacturers from liability for certain injuries caused by their vaccines (giving injured patients compensation from the government instead). The autism community believes Congress intended to provide “limited” protection and parents are free to sue for damages in civil court due to design defects.

The government, on the other hand contends Congress intended to provide “blanket” immunity to the pharmaceutical industry and the proper recourse for parents is the vaccine court.
